Global Omega-3 Day Contest Official Rules

 

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE RESTRICTED OR PROHIBITED BY LAW.

Participation in the Nature’s Way Canada Global Omega-3 Day Contest (the “Contest”) is deemed to be an acceptance of these official rules (“Official Rules”) and any other notices referenced herein. The Contest is governed by these Official Rules, and is subject to all applicable federal, provincial, and local laws. Nature’s Way Canada Limited (“Sponsor”) is the sole sponsor of this Contest. In these Official Rules, the term “you” refers to any person who enters, or who wishes to enter, the Contest.

  1. CONTEST PERIOD

The Contest begins at 9:00 AM Atlantic Standard Time (“AST”) on March 3, 2025 and ends at 11:59 PM AST on March 7, 2025 (the “Contest Period”), when all entries must be received. Atlantic Standard Time shall control for all purposes of the Contest.

  1. ELIGIBILITY

2.1 The Contest is open only to:

(a)      current legal residents of Canada (excluding residents of the Province of Quebec); and

(b)     who have reached the age of majority in the province or territory of residence at the time of their entry to the contest.

2.2 The following people are not eligible to enter the Contest or to receive the Prize:

(a)      Employees of Sponsor; and

(b)     Employees of Sponsor’s parent, affiliates, subsidiaries, divisions, and advertising or promotional agencies participating in this Contest, and their immediate family members (collectively with Sponsor, the “Contest Entities”).

“Immediate Family and household members” means parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. “Household members” means people who share the same residence at least three months a year, whether related or not.

2.3 In order to enter the Contest or receive the Prize, you must fully comply with these Official Rules, and by entering, you represent and warrant that you agree to be bound by these Official Rules and the decisions of the Sponsor-designated judges, whose decisions are binding and final in all respects relating to this Contest.

  1. HOW TO ENTER

You may enter the Contest during the Contest Period as follows:

      Log-in to your Instagram account, and (i) follow @natureswaycanada and @nutrasea_nutravege; (ii) like the Contest post posted @natureswaycanada or @nutrasea_nutravege; and (iii) tag two (2) friends in the comments of the Contest post using the hashtag #Omega3DayContest. (“Entry”).

By submitting the Entry, you agree to the Instagram Terms of Use available at https://help.instagram.com/termsofuse. This Contest is in no way sponsored, endorsed or administered by, or associated with, Instagram LLC. IMPORTANT: MESSAGE AND DATA RATES MAY APPLY TO USE OF MOBILE PHONE/DEVICE TO PARTICIPATE IN CONTEST. INSTAGRAM IS FREE TO DOWNLOAD AND AVAILABLE FOR iPHONE FROM THE APPLE APPLICATION STORE AND FOR ANDROID FROM THE GOOGLE PLAY STORE.

Upon the submission of your Entry in accordance with these Official Rules, you will receive one (1) or more ballots into the Contest.

LIMIT: You may only submit one (1) Entry per personal Instagram account. You must NOT (i) use multiple Instagram accounts to submit multiple Entries through multiple Instagram accounts; or (ii) submit more than one comment per Entry. 

ALL ENTRIES MUST BE RECEIVED BY March 7, 2025 at 11:59 AST. Entries submitted to Instagram will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Mechanically altered or reproduced entries are not eligible. The use of robotic or automatic devices for entering the Contest is prohibited and Sponsor reserves the right to nullify all such entries and to disqualify the responsible individual from entering. Normal internet access and usage charges imposed by your online service will apply and are your sole responsibility. Sponsor is not responsible for lost, late, misdirected, corrupted, incomplete or damaged entries. Proof of submission is not proof of receipt by Sponsor.

Please note Instagram profile does not need to be public. Entries may not be acknowledged and will not be returned. Multiple entrants are not permitted to share the same social media account. Any attempt by an entrant to obtain more than the allotted number of Entries by using multiple/different accounts or any other methods will void all that entrant’s attempted entries and that entrant may be disqualified. By submitting an Entry in the Contest, you warrant and represent that your Entry conforms to these Official Rules.

The failure to submit all required information in the manner required in these Rules, as determined by the Sponsor in its sole discretion, may result in the disqualification of an Entry. Proof of submission of an Entry will not be deemed to be proof of receipt by Sponsor. All entrants, participants and Entries are subject to verification by the Sponsor, as are the eligibility, age and other claims of/information provided by an entrant or potential prize winner.

  1. SUBMISSION GUIDELINES

All Entries must comply with the following “Submission Guidelines”:

 

4.1    Entries must NOT violate the rights of any other party, including but not limited to intellectual property rights or rights of privacy, publicity or other moral rights.

 

4.2      Entries must NOT contain or consist of: (a) advertising or commercial content for any party other than the Sponsor; (b) content that endorses/promotes illegal or harmful activity; (c) violent, profane, vulgar, obscene, defamatory or otherwise objectionable material; (d) adult material; or (e) defamatory content.

 

The Sponsor reserves the right to disqualify any participant who violates these prohibitions or any other provision of these Official Rules, or that could damage the reputation or business of the Sponsor, as determined by the Sponsor, in their sole discretion. You represent and warrant that your Entry does not make unauthorized use of, or violate, any rights of any third party, and that, if necessary, you can provide proper permissions in a form acceptable to the Sponsor.

 

Any submission that does not comply with any aspect of these Submission Guidelines or the Official Rules, as determined by the Sponsor in its sole discretion, may be rejected by the Sponsor and the entrants disqualified. Entrants will cooperate with the Sponsor and its representatives in connection with any and all verification activities.

 

  1. PRIZE

There is a total of one (1) prize (the “Prize”) consisting of: (i) one (1) bottle of Nature’s Way® NutraSea® Omega-3, Lemon (16.9 fl oz (500 ml)) (ARV: $67.99); (ii) one (1) bottle of Nature’s Way® NutraSea® Omega-3 Kids Gummy Chews Tropical Citrus Gummies (30 Count) (ARV: $29.99); (iii) one (1) bottle of Nature’s Way® NutraSea+D Omega-3 Liquid Gels, Fresh Mint  (150 Count) (ARV: $73.99); (iv) one (1) bottle of Nature’s Way® NutraVege Omega-3, Plant Based, Extra Strength, Cranberry Orange (16.9 fl oz (500 ml)) (ARV: $99.99); and (v) Nature’s Way® NutraVege Omega-3 Plant 75 Liquidgels Mint (75 Count) (ARV $55.99).  The total approximate retail value (“ARV”) is: $327.95. Prize is non-transferable, and no substitution will be made except as provided herein or otherwise at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any part of the prize for one of equal or greater value if the designated prize should become unavailable for any reason. All federal, provincial, and local taxes on the prize are the sole responsibility of the winner. ARV of all prizes is in Canadian dollars.

ODDS

Odds of winning depend on the total number of ballots per eligible Entry received during the Contest Period.

  1. WINNER SELECTION AND NOTIFICATION

One (1) potential winner will be selected in a random drawing by the Sponsor-designated judges from all eligible ballots per Entry received during the Contest Period in a random drawing to be held on or about March 10, 2025. The potential winner will be notified within 24 hours of the draw via Instagram Direct Message (“DM”), and will be asked to provide their email address and residential address. Potential winners will be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law) (collectively, the “Affidavit”) within three (3) days of the date specified on notification and correctly answer, unaided, a time-limited mathematical skill testing question administered at a mutually agreeable time by telephone. If a potential prize winner does not return the executed Affidavit within three (3) days, fails to correctly answer the skill testing question within the time frame provided, or if said e-mail and/or mail is returned as undeliverable, or if an entrant is otherwise found to be ineligible, or if a selected winner cannot accept or receive the prize for any reason, the potential prize winner will forfeit the prize and an alternate winner will be selected who will be subject to disqualification in the same manner.

Within two (2) to four (4) weeks following Sponsor’s receipt of the duly completed and signed Affidavit and correctly answered skill testing question, Sponsor or its representative will contact the winner by email to inform the winner of the way they can take possession of their Prize. Prize must be accepted as described in these Rules and by the Sponsor in its communications with the potential winner. Prize will be mailed directly to each winner by Sponsor.

  1. PUBLICITY RELEASE; USE OF PERSONAL INFORMATION

Except where prohibited or restricted by law, winner’s acceptance of a prize constitutes the winner’s agreement and consent for Sponsor to use and/or publish winner’s full name, city and province of residence, photographs or other likenesses, entry, pictures, portraits, voice, testimonials, biographical information (in whole or in part) and/or statements made by winner regarding the Contest or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including but not limited to print, TV, radio, electronic, cable, or World Wide Web, without limitation, restriction, compensation, notice, review, or approval. Personal information collected by Sponsor will be used for administration of the Contest and awarding the prizes. In addition, by entering, entrants agree to Sponsor’s use of entrant’s personal information for Sponsor’s marketing purposes and as described in its privacy policy at https://shop.natureswaycanada.ca/pages/privacy-policy . Please refer to Sponsor’s privacy policy for important additional information regarding collection, use, and disclosure of personal information by Sponsor. Sponsor is not responsible for disclosures made by any third party. Entrants may subsequently opt-out of receiving emails as set forth in Sponsor’s privacy policy or by unsubscribing via any unsubscribe link.

 

  1. NO TAMPERING; RIGHT TO CANCEL, MODIFY

Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Official Rules, (b) entries, prize claims or notifications that are lost, late, incomplete, illegal, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind including but not limited to, inactive email accounts or entrants failure to monitor his/her account; (c) entrants who have committed fraud or deception in entering or participating in the Contest or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor's reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this promotion or any promotion or prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Contest, or with any website promoting the Contest; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Contest multiple times through the use of multiple social media accounts or the use of any robotic or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Contest, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Contest promotion, including the entire Contest promotion, and/or modify the Contest and/or conduct a random drawing to award the Prize using all eligible Entries received as of the termination date.

  1. RELEASE OF LIABILITY; DISCLAIMER OF WARRANTY; FORUM SELECTION CLAUSE

By participating in the Contest, entrants and winners agree to release, indemnify, and hold harmless Sponsor, Instagram, and their respective subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors, as well as Instagram LLC and their respective subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors (the "Released Parties"), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation, property damage, personal injury (including emotional distress), and/or death, which may occur in connection with preparation for, or participation in, the Contest, or possession, acceptance and/or use or misuse of the prize or participation in any Contest-related or prize-related activity and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery. Instagram does not sponsor, endorse or administer this contest. The Released Parties assume no responsibility for any injury or damage to entrants or to any other person's computer, regardless of how caused, relating to or resulting from entering or downloading materials or software in connection with this Contest. Entrants and winners acknowledge that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representations or guarantees, express or implied, in fact or in law, relative to any prize or any component thereof, including, but not limited to, express warranties provided by the supplier of the prize (or any component thereof) or their affiliates. All issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules or the rights and obligations as between the entrant and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Nova Scotia without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. Entrants agree (and agree to confirm in writing) that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court of competent jurisdiction to be unenforceable; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and/or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. The Contest is subject to all applicable federal, provincial and local/municipal laws and is void where prohibited by law. If any provision of these Official Rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.

  1. LIST OF WINNERS

To obtain the name of the Contest winner, send a written request with a self-addressed, stamped envelope to Nature's Way Canada Limited, Customer Service Department, 15 Garland Avenue, Unit 4, Dartmouth, Nova Scotia, B3B 0A6.

  1. SOCIAL MEDIA

Instagram is a registered trademark of Instagram, LLC. This Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. Any information provided for the purposes of entry in the Contest is provided to Sponsor, and not to Instagram. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Instagram. Instagram and all of their affiliates, directors, officers, agents and employees are not liable for any claims arising out of or in connection with the organization of this Contest. However, by entering this Contest, each entrant agrees to abide by the terms and conditions of use and other policies or guidelines governing the use of the specific social platform and releases the Sponsor and the Released Parties from and against any damage that could arise from the use of such platforms.
